MBE SCORE TRANSFERS
Transfer of MBE Score from another jurisdiction to New York: As set forth in
Board Rule 6000.6(g)(1), an applicant taking the New York bar examination shall
have the option to transfer to New York an MBE score from another jurisdiction
that was attained either at a concurrent examination taken on the same day that
such examination is given in New York or as part of a passing examination in
another jurisdiction during any of the three administrations of the bar
examination immediately preceding the administration during which the applicant
sits for the New York section of the bar examination. The MBE scale score
attained in such other jurisdiction will be combined with the applicant's scores
on the New York section of the examination, in the same manner as if the
applicant had taken the MBE in New York. An applicant who elects to use an MBE
score from another jurisdiction as permitted above shall notify the Board of
such election at the time that the application to sit for the New York State bar
examination is filed, and shall make the arrangements to have such score timely
transferred to New York.
(i) To transfer a concurrent or prior MBE score to New York from another
jurisdiction the applicant must complete the MBE score transfer form available
on the website of the National Conference of Bar Examiners (NCBE) at http://www.ncbex.org/multistate-tests/mbe/services/transfers/and
pay the prescribed NCBE score transfer fee. If the transferred MBE score was
attained during one of the three prior administrations of the MBE, the applicant
must also provide proof from the other jurisdiction, on a form provided for that
purpose by the Board, that the MBE score was attained as part of a passing
examination in such other jurisdiction.
(ii) The transferred MBE score, and if necessary, proof from the other
jurisdiction that the prior MBE score was attained as part of a passing
examination, must be received in the Board’s office no later than April 1
following a February examination, and no later than October 1 following a July
examination. It shall be the applicant’s responsibility to ensure that the Board
receives the report of the transferred MBE score in a timely manner. Failure to
timely transfer an MBE score to the Board, or failure to file the required proof
of a passing examination from the other jurisdiction shall result in the
nullification of an applicant’s bar examination scores.
Non-
Resident Applicants Now Offered Choice of Test Locations
Under new rules, non-NY resident applicants may now choose to
take their test in Albany, Buffalo or Saratoga Springs. The previous rule put
all non-residents in Albany. Hotel rooms in each city fill early for exam dates,
so be sure to make a reservation in Albany as well as your preferred test
location and cancel the unnecessary room when you receive your admission ticket
(usually 2-3 weeks before the exam).

Passing Score Remains at 665
The new required passing score has been held at 665 rather than the increase previously announced...
On January 10, 2007 the Board of Law Examiners issued the following notice:
The State Board of Law Examiners announced today that the passing score for the February and July 2007 bar examinations will remain at 665 out of 1000 points. This is the same score that has been required to pass the examination since July 2005. Prior to July 2005, the passing score was 660.
The Board will continue to analyze the impact of the prior increase in the passing score. The National Conference of Bar Examiners has conducted a study of that impact based on the results of the July 2005 bar examination. Further study is underway regarding the 2006 examinations.
The Board recently met with representatives of the New York law schools and the New York State Bar Association Committee on Legal Education and Admission to the Bar to discuss the study. The Board also recently met with the State Bar Association Special Committee to Study the Bar Examination and Other Means of Measuring Lawyer Competency to discuss issues related to the assessment of law graduates’ readiness for practice.
The format of the NY Bar Exam remains steady since 2001
The 2001 changes included the addition of the Multistate Performance Test (MPT), a reduction in essays from 6 to 5 and a reduction in issues per question from 4 to 3. The time allocation to answer essay questions is 40 minutes per question. The grading allocation continue to be 10% NY Multiple Choice Questions; 10% MPT; 40% NY Essays; 40% MBE.
